Decibel Meter and Bike Sounds
In addition to the Audio Pin, Forensic Linguistic analysis, Animations, Polygraphs, etc. this case lends itself to Decibel Meter Exhibits. Although most courts would not allow three 90 decibel motorcycles to be simulated at full volume (since the sounds are additive, and human hearing is damaged at 140 db), the Judge or Jury can certainly be shown the effect of this extreme sound both on pedestrian's defensive startle reaction, and on bikers' inability to hear anything clearly.
Without a jury, we would then ask the judge to imagine 12 elderly jurors, frail, with mobility problems, being surprised by three bikes loud enough to damage human hearing! A verbal "slow down" defensive startle reaction would then seem not only reasonable, but extremely reserved and conservative given that disparity of force. A good example is to imagine the three bikers approaching pedestrian with THREE CHAIN SAWS-- 90 decibels also is the sound level of a single chain saw, and the bikes are MORE DANGEROUS than chain saws at these speeds.
