Defamation Cause of Action
Although some of the exhibit elements on this site would be allowed or disallowed depending on the Court in question (eg: pedestrian's poly, demonstrating conclusively bikers are lying), all elements on this site would be allowed (including the poly) in a civil suit where pedestrian sues bikers and their families for Defamation of Character. Since the Defamation also involves lying on a police report, and lying to accuse pedestrian of a crime, this is called libel per se. It also is slander, since bikers lied verbally to police about pedestrian, as is more than obvious via the exhibits on this site.
Many personal injury (PI) firms consider Defamation to be within their purview, especially with a very ill pedestrian for whom the stress of being falsely accused with lies demonstrably affected his health, and will work on contingency, investing in many of the tools you see on this site. Since bikers used the "system" rather than their own funds to cause pedestrian financial loss in hiring an attorney, as well as damage to his health, using a PI firm to sue for Defamation on contingency would be a potent defense by pedestrian. That being the case, why would pedestrian hire a defense firm, when he could have gotten completely free representation by a PI firm, and received a major settlement, given the overwhelming evidence of the biker's lies on this site?
Pedestrian stated: "It's about the law of intent (what you intend is what comes back to you). All along, I intended to protect these bikers, from their own speed and recklessness, and from injuring themselves and others. I intended protection, and I will be protected. Since they intended to lie to defame the character of an old man, their intent will be their own punishment-- their lies will defame their own characters, and I am sad about that. I don't need to do anything to harm them or their families, and don't believe in starting or furthering neighborhood wars. My friends say I am naive because 'he who calls police first is the victim', and 'he who files first wins', but attacking a neighbor goes against everything I believe in. I don't have that much time left as a fully functional old guy, and I sure don't want to spend what I do have left suing and battling with my own neighbors."
