Pedestrian in this case is elderly, disabled and seriously ill. He has had numerous strokes, and his prognosis for death or disability is for 18 months or less from the incident. He is medically bankrupt, and needs over $900,000 in surgeries, including Carotid Angioplasty, Esphogeal, Vascular, Cardiac and GI/GU surgeries. In addition, he has diabetes, heart disease, kidney disease, thyroid disease, prostate disease, and is inoperably blind in his right eye.

Relevance includes diabetic Neuropathy in foot, limited mobility and tremors on right side from strokes, and many other motion affecting conditions, including vertigo. Pedestrian also suffers from medical anxiety, especially from vehicles, due to the death of his young wife in a 4 wheeling roll over accident, the death of his second wife from breast cancer, and he himself being hit from behind when he was young, while jogging, at 55 mph, destroying his hip and knees. These factors alone make the disparity of force issue central.

Pedestrian spent his entire career caring for terminally ill children with high technology devices and solutions, and founded the Splendor Kids Foundation for kids with terminal illness. He has a unique knowledge both of the death of young people, and the destructive power of vehicles in inexperienced hands.
